This Fair use policy is aimed at providing the largest possible group of XiBE users satisfactory access to and undisturbed use of the services of the Idea Fulfilment platform XiBE, based upon normal use.
This Fair use policy provides the guidelines by which Pridea may take any measures, by the guideline 'if there is no need, there will be no intervention’. This Fair use policy applies to all users and agreements, regardless of the moments user has access to XiBE or when the agreement came into force.

Excessive and/or improper use and nuisance
To prevent excessive and/or improper use of XiBE and avoid any inconvenience to other users, Pridea reserves the right to take measures such as (i) charge retroactively to the moment of first report additional compensation fees, (ii) (temporarily) regulate existing user access to specific functionalities, and (iii) any other (legally permitted) measures.
The following behaviour is, amongst others and not exclusively limited to, considered as excessive and/or improper use and/or nuisance:
1) excessive use that repeatedly causes a network overload and/or overload of the XiBE platform and/or impediments to other users;
2) use of software to simulate user activity and/or to submit large amounts of data and/or to manipulate usage.
Whenever excessive and/or inappropriate use and/or nuisance arising from any user account is detected, Pridea will inform the related organization and will requested adequate measures to be taken immediately (warning). Whenever, because of high urgency, prior notice is not possible, Pridea will inform the related organization as soon as possible. Organizations and users are, after receiving a warning, required to change the use of the XiBE platform.

The assessment of the need for intervention under this Fair use policy and the measures to be taken is to the sole discretion of Pridea. Pridea is not liable for any damage arising from measures taken based upon this Fair use policy. These measures shall not affect any rights Pridea has to recover damages or to prevent further damages.
